Terms and Conditions

This website and service, connect.shortfundly.com (the “Connect” platform), is operated by SM Smartygen Media Networks Pvt Ltd (“Shortfundly”, “we”, “our”, or “us”). By accessing or using Connect, you (the “user”, “you”, or “end user”) agree to be bound by these Terms and Conditions (the “Terms” or “Agreement”). Certain features are password-protected and restricted to authorized users. If you do not agree, do not access or use Connect.

Scope and Purpose

Shortfundly Connect is a professional networking and collaboration marketplace for creators and industry professionals. Core capabilities may include (without limitation): profiles/EPKs, reels and portfolios, messaging and inbox, casting/job listings, applications and bookings, recommendations/endorsements, event discovery, groups/communities, referrals, and calendar tools. Some modules may interoperate with other Shortfundly properties (e.g., Hub/Tools) or approved third-party systems.

Eligibility and Account

You must be at least 18 years old (or age of majority in your jurisdiction) and able to enter a legally binding agreement. You are responsible for safeguarding your credentials and all activity on your account. Notify support@shortfundly.com immediately if you suspect unauthorized access.

Community Standards & Acceptable Use

• No harassment, hate speech, discrimination, impersonation, spam, or abusive behavior.
• No posting of unlawful, infringing, defamatory, obscene, or sexually explicit content.
• No scraping, bulk harvesting of data, or automated access except as expressly permitted.
• No malware, phishing, or attempts to gain unauthorized access to accounts or systems.
• No misrepresentation of skills, credits, availability, or identity.
• No off-platform solicitation that violates these Terms or applicable law.

Profiles, Portfolios & User Content

You are responsible for your profile information, credits, reels, images, EPKs, and other materials (“User Content”). You represent and warrant you own or control all necessary rights and that your User Content complies with law. You grant Shortfundly a non-exclusive, worldwide, royalty-free license to host, reproduce, transcode, display, and use User Content solely to operate Connect and provide selected features (e.g., search, discovery, messaging, listings). You may remove your content, subject to legal or operational retention requirements.

Listings, Casting Calls & Applications

• Posters must ensure listings are accurate, lawful, and include genuine opportunities (roles, dates, rates, location/remote, and required materials).
• Applicants must submit truthful information and only apply when reasonably qualified/available.
• Shortfundly is not a party to contracts between posters and applicants. We are not an employment agency and do not guarantee jobs, rates, or outcomes.

Bookings, Payments & Fees

If Connect later supports bookings, escrow, or payments, additional terms will apply and be shown at checkout or during onboarding. Platform fees, escrow terms, dispute windows, refund eligibility, and tax responsibilities will be disclosed in-product. Unless otherwise stated, you are responsible for your taxes, filings, and withholdings.

Messaging, Safety & Reporting

Use messaging professionally. Do not share sensitive data unless necessary. If you encounter suspicious activity, harassment, or policy violations, report it via in-product tools or email support@shortfundly.com. We may investigate and take actions at our discretion, including warnings, removal of content, feature limits, or account suspension/termination.

Ratings, Reviews & Endorsements

Where enabled, feedback must be fair, factual, and free from conflicts of interest. We may remove content that is abusive, fraudulent, irrelevant, or violates law/policy. Shortfundly does not verify the accuracy of feedback and is not liable for user opinions.

Verification & Identity

We may offer or require verification (IDs, reels, credits) for trust and safety. Verification does not guarantee employment, competence, or outcomes. We may revoke verification if signals indicate misuse or misrepresentation.

Intellectual Property

Connect, its software, design, and compilation are owned by Shortfundly, its licensors, or service providers, and protected by IP laws. “Shortfundly” names and logos are trademarks or service marks of Shortfundly. No license is granted except as expressly authorized in these Terms or in writing.

Data, Accuracy & No Professional Advice

Discovery results, suggestions, and analytics may use user-provided, Shortfundly, and third-party sources. Information can be incomplete or change without notice. Outputs are informational only and do not constitute legal, financial, employment, or other professional advice. Use your own judgment.

Privacy

Our Privacy Policy explains how we collect, use, and share personal data in connection with Connect and forms part of these Terms. By using Connect, you consent to our data practices. Review it at shortfundly.com/privacy (and any product-specific notices presented in-product).

Third-Party Links & Services

Connect may link to or interoperate with third-party services (e.g., storage, analytics, video hosting, payment processors). We do not control and are not responsible for third-party content or policies. Your use of third-party services is subject to their terms.

Beta & Experimental Features

Pre-release features may be offered “as is” and can change or be discontinued without notice. Additional terms may apply.

Service Changes & Availability

We may modify, suspend, or discontinue any feature at any time. We do not guarantee uninterrupted or error-free operation and may impose limits or access restrictions to protect the service or comply with law.

Termination

We may suspend or terminate access (in whole or part) at any time for policy violations, misuse, suspected fraud, non-payment (if applicable), or legal/compliance reasons. Upon termination, your right to access Connect ceases immediately; provisions that by their nature should survive will do so (e.g., IP, disclaimers, limitations, indemnities).

Disclaimers

CONNECT AND ALL MATERIALS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT WARRANT THAT CONNECT WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHORTFUNDLY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) CONNECT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO CONNECT SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO SHORTFUNDLY FOR CONNECT IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Indemnification

You agree to indemnify, defend, and hold harmless Shortfundly, its officers, directors, employees, agents, and partners from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of Connect; (b) your User Content; (c) your breach of these Terms; or (d) your violation of any third-party rights or applicable law.

Copyright Complaints

If you believe that content available through Connect infringes your copyright, please send a notice containing: (i) your physical or electronic signature; (ii) identification of the copyrighted work; (iii) identification of the infringing material and its location; (iv) your contact information; (v) a statement of good-faith belief that the use is not authorized; and (vi) a statement, under penalty of perjury, that the information is accurate and you are authorized to act for the owner. Send notices to support@shortfundly.com. We may remove or disable access to allegedly infringing content and may terminate repeat infringers.

Confidentiality

You may gain access to non-public information, including product plans, pricing, and workflows. You agree to keep such information confidential and use it solely for your permitted use of Connect.

Changes to These Terms

We may update these Terms from time to time. The “Date of Last Update” below reflects the latest revision. Your continued use of Connect constitutes acceptance of the updated Terms.

Governing Law & Jurisdiction

These Terms shall be governed by the laws of the Republic of Singapore, without regard to conflict of laws principles. You submit to the exclusive jurisdiction of the courts of Singapore for any dispute arising from or relating to these Terms or Connect.
